The German version is legally binding.

These terms apply to using Lingotivo Deutsch (formerly LingoExam) at deutsch.lingotivo.com and to buying Pro packages.

1. Provider and scope

The provider is Melih Firat (“we”). These terms apply to all contracts between us and our users (“you”) for the Lingotivo Deutsch web app. Other terms apply only if we expressly agree to them.

The iPhone and iPad apps are sold through the App Store; they have their own terms, e.g. Deutsch A1, and Apple’s terms also apply to them.

2. Services

Lingotivo is a learning app to prepare for the German A1 to B1 exams. A free account gives you selected content (including the first mock exam of every module, one free vocabulary theme and introductory grammar topics).

For a fee you can buy these Pro packages: A1 mock exams, A2 mock exams, B1 mock exams, Grammar A1–B1 and Flashcards A1–B1, as well as “Everything”, which includes all packages. The pricing page describes exactly what each includes.

Lingotivo is independent and not affiliated with any exam provider. We provide learning content; we do not promise that you will pass an exam.

3. Account

You need an account. Your details must be correct. Keep your password secret; an account is for one person and may not be shared.

You can delete your account at any time in Settings. This ends any running subscriptions; periods already paid for are refunded only where the law requires.

4. How the contract is made

Showing the packages is not a binding offer. You choose a package and billing period on the pricing page or in the unlock dialog, accept these terms and are taken to the payment page of our payment provider Stripe. By clicking the button to pay, you make a binding offer. The contract is made when the payment is confirmed; the content is then unlocked immediately.

The contract languages are German and English. We don’t store the contract text separately; you can view and save these terms on this page at any time. We confirm your purchase by email.

5. Prices and payment

The prices shown when you order apply. All prices are final prices including VAT. You pay in advance for each billing period through Stripe, using the payment methods offered there.

We announce price changes for existing subscriptions at least six weeks in advance in text form. They apply only from the following billing period; until then you can cancel free of charge.

6. Term, renewal and cancellation

Monthly packages run for one month, yearly packages for one year. They renew for the same period unless cancelled before. After the first term, you can cancel a renewed subscription at any time with no more than one month’s notice.

A cancellation takes effect at the end of the current, already paid period; you keep access until then. You can cancel with the Cancel contracts here button, under “Manage billing” in Settings, or in text form to melihfiratapps@gmail.com. The right to terminate for good cause remains unaffected.

7. Right of withdrawal

Consumers have a statutory right of withdrawal; see the right of withdrawal page for details.

Before buying, you expressly agree that we begin providing the digital content before the withdrawal period ends, and confirm that you know your right of withdrawal expires once we begin.

8. Availability and changes

We aim for the service to be available without interruption but cannot guarantee it, especially during maintenance or disruptions beyond our control.

We may improve and update content. We will not reduce essential parts of a package you bought during the paid term. The free content may change.

9. Rights of use

All content (texts, tasks, audio, graphics) is protected by copyright. You receive a simple, non-transferable right to use it for your own learning for the duration of the contract. In particular, you may not copy, share or publish the content or read it out automatically (scraping).

For serious or repeated violations we may suspend the account or terminate the contract for good cause.

10. Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under the Product Liability Act.

For slight negligence we are liable only for breaches of essential contractual obligations (obligations that make performing the contract possible in the first place and on which you may regularly rely), limited to the damage typical for the contract and foreseeable. Otherwise liability is excluded.

11. Changes to these terms

We may change these terms for the future if there is a good reason (e.g. new features or changes in the law). We will tell you at least six weeks in advance in text form. If you don’t object within that time, the changes are accepted; we will point this out in the notice. Prices and essential services are not changed this way.

12. Final provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not remove the protection of mandatory provisions of the country where they habitually live.

The European Commission’s online dispute resolution platform was discontinued on 20 July 2025. We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.

If individual provisions are invalid, the rest of the contract remains valid.

The German version of these terms is legally binding.
